Definition 1
Als Gewerbe ist jede selbständige (d.h. auf eigene Rechnung und Gefahr), regelmäßige und auf wirtschaftlichen Vorteil gerichtete Tätigkeit zu verstehen. Nicht unter Gewerbe fallen grundsätzlich: unselbständige Tätigkeiten, Land- und Forstwirte samt ihrer Nebengewerbe, land- und forstwirtschaftliche Erwerbs- und Wirtschaftsgenossenschaften, Buschenschank, Literatur, Kunst, Selbstverlag der Urheber. Die Gewerbe unterteilen sich grundsätzlich in Handwerke (benötigen Befähigungsnachweis bzw. Nachsicht), bewilligungs- oder nicht bewilligungspflichtig gebundene Gewerbe (benötigen Befähigungsnachweis bzw. Nachsicht) und freie Gewerbe (kein Befähigungsnachweis erforderlich). Das heimische Gewerbe und Handwerk hat 1999 insgesamt 595.400 Arbeitnehmer beschäftigt, um 3,1 Prozent mehr als im Vorjahr. Wie das Institut für Gewerbe- und Handwerksforschung am Dienstag mitteilte, war das Gewerbe damit weiterhin größter Arbeitgeber im Land, vor dem Handel mit 456.000 und der Industrie mit 453.000 Beschäftigten. Innerhalb des des Gewerbes verbuchten die Wirtschaftsdienstleister mit einem Beschäftigungsplus von 15,6 Prozent weiter die größten Zuwächse.

Any permitted gainful activity of a certain duration that is pursued on a self-employed basis, excluding the professions and primary agricultural production. (The meaning also covers the English terms "trade" in its occupational sense and "industry" in the broad sense of any particular branch of activity.) The term "Gewerbebetrieb" therefore refers to any firm in commerce, small-scale crafts and trades, manufacturing industry and transport. The conduct of a business is regulated specifically in the Industrial Code (Gewerbeordnung) and by numerous supplementary statutes such as the Crafts Code (Handwerksordnung), the Retail Trade Act (Einzelhandelsgesetz) and the Hotels and Catering Act (Gaststättengesetz) and regulations for banks and credit institutions, insurance companies and the like.
