Definition 1
A unilateral declaration of intent by one contracting party to the other to the effect that the contractual relationship is to be ended at a specified time. It takes effect when it is received by the contracting partner. Unless provisions in the contract of employment or a collective agreement regulate otherwise, no special formalities need be observed in terminating an employment relationship. It can even be done orally. Except in cases of dismissal for variation of contract its validity may not, however, be made dependent on certain conditions. A distinction is made between ordinary termination with notice , by which the employment relationship is ended when the period of notice expires, and summary termination , which brings about immediate cancellation of the employment relationship. Termination by the employer is unlawful if it contravenes one of the regulations of protection against dismissal or a contractual restriction of the right to terminate and the employee then invokes these grounds.
