Zur Herstellung des Benehmens mit der Bundesbank ist eine umfassendere Erörterung und Auseinandersetzung mit deren Auffassung mit dem Ziel der Verständigung erforderlich, ohne dass bei divergierenden Meinungen am Ende eine Bindung an die Auffassung der Bundesbank besteht. Beispiele: Das Bundesministerium der Finanzen hat das Benehmen mit der Bundesbank vor dem Erlass von Rechtsverordnungen herzustellen, die - für Unternehmen, die nur das Geldkartengeschäft betreiben, Einzelheiten zu Erleichterungen bestimmen (§ 2 Absatz 5 Satz 3 KWG), - die Eigenmittelausstattung von Institutsgruppen und Finanzholding-Gruppen näher regeln (§ 10a Absatz 6 Satz 10 KWG) und - Art, Umfang und Zeitpunkt der bankenaufsichtlichen Anzeigepflichten näher bestimmen (§ 24 Absatz 4 Satz 1 KWG). Das Bundesaufsichtsamt hat das Benehmen mit der Bundesbank vor dem Erlass von Rechtsverordnungen herzustellen, die - Institute von Anzeigepflichten freistellen (§ 31 Absatz 1 Satz 2 KWG) beziehungsweise - Unternehmen, die nur das Geldkartengeschäft betreiben, von bestimmten Vorschriften des KWG ausnehmen (§ 2 Absatz 5 Satz 1 KWG).
