Spesen- und Provisionsschinderei durch einen Vermögensverwalter Der Begriff stammt aus dem US-amerikanischen Kapitalanlagerecht und heißt in direkter Übersetzung eigentlich "Buttern". Das Wertpapierdepot (die "Milch") eines Anlegers wird beim Churning so oft bewegt, dass die Gebühren (die "Butter") entnommen werden können, während dem Anleger nur noch ein erheblich reduziertes Depot (die "Magermilch") bleibt. Sofern dadurch nicht der strafrechtliche Tatbestand des Betruges verwirklicht wird, ist diese Praktik nach § 14 Z 1 WAG untersagt. Verstöße werden von der BWA mit Verwaltungsstrafen bis zu 300.000,-- Schilling sanktioniert.

Churning refers to excessive buying and selling in your account by your broker. For churning to occur, your broker must exercise control over the investment decisions in your account, either through a formal written discretionary agreement or otherwise, and must engage in excessive trading in light of the financial resources and character of the account for the purpose of generating commissions. The major securities industry self-regulatory organizations have rules prohibiting churning. You'll find the NASD's churning rule – Rule 2310-2(b)(2) – in the "NASD Manual."
